Case Studies Contracts, Business, And Laws - 5126 Words

Case Studies Analyses Contracts, business, and laws are three simple little words, but when put together they have a substantial impact on our everyday lives. Below we will discuss three case studies. The first case is between Chris, Matt, and Ian vs. Donald Margolin, who was injured when he used an aftershave lotion that he bought off the internet called Funny Face. The second case is between Sam, his landlord, and a national chain store. Sam is being accused of conducting business from his apartment and going back on a verbal promise. In the last case is two lifelong friends who decided to join in a partnership and open up a sporting goods shop. Therefore, before the appropriate court can proceed with the first case, the court should take into several considerations around the rules of jurisdiction, alternative dispute resolution (ADR), and whether or not corporation/or corporate offices can be held for the criminal or potential act. In the second case before the court can rule the court should determin e the various elements of a valid contract, if a quasi-contract exists, a promissory estoppel, and the rights an obligation of a tenant would prevail on Sam s claims. Finally, in the third case between Jeb and Josh, they should determine the type of business entity that will overall protect their business and personal needs. The Impact of Performance Enhancing Drugs on Sports Essay

The Impact of Performance Enhancing Drugs on Sports One of the major issues in the news recently has been the use of performance enhancing substances in sports. This topic has been the subject of many front-page headlines in many publications, from sports magazines to newspapers. A recent scandal involving a San Francisco Bay Area laboratory, BALCO Laboratories, has brought this issue to the forefront, and its really gotten a lot of attention because this case has led to a 42 count federal indictment by the U.S. Attorney General.[1] Another question can be asked as well: Should these performance-enhancing substances be allowed in sports? First of all, what exactly are performance-enhancing substances? They are just what they†¦show more content†¦Late that summer, a bottle of androstenedione, a steroid that is produced by the body but is considered a banned substance by the U.S. Anti-Doping Agency, was found in McGwire?s locker. Because Major League Baseball did not consider androstenedione a banned substance, he could use it without penalty, but questions were raised about the legitimacy of any records he may have set. The other problem regarding androstenedione is the lack of testing that has been performed on it.[4] The Problems with Steroids What are the problems with steroid use? First, one needs to understand why steroids are used to begin with. The main reason why athletes take steroids, as mentioned above, is to increase muscle mass and endurance while training for or participating in a sport. One might ask, ?Don?t they test athletes to make sure they don?t use them In some cases, sports agencies do. For example, the United States Olympic Committee, in their publication Selected National Anti-Doping Policies, they list when tests are to be administered and what the regulations are for each type of drug and for each sport.[5] However, the problem that faces drug testers are what are known as designer drugs, or drugs that are made to avoid showing up on a drug test. Odysseus vs. Gilgamesh Essay Example For Students

Odysseus vs. Gilgamesh Essay Character is built in several different ways. Some may view character as how one handles a certain hectic situation or how well one person treats another. A true definition character contains these elements, but ones character is built and developed mainly on how one picks and chooses his time to act and his time to wait. This definition refers to restraint and discipline. Gilgamesh and Homers The Odyssey uses many instances in which the main characters must use incredible restraint to protect not only themselves, but also the ones they care for and love. Although both stories use this theme of self-control and discipline to develop certain personalities, each one tells a different account of how these characters are viewed by their fellow men and women and the rewards that come from showing the traits of restraint and self-will. In Gilgamesh, the character that holds back and exhibits patience is viewed as a coward, as Gilgamesh believes, and is a sign of a lack of bravery and confidence. The way that patience is portrayed in Gilgamesh reflects how the society of the time feels about everything in their lives. The author of this story wants the reader to believe that one must not hesitate and must act decisively and quickly. Opposing this belief, Odysseus holds back emotions of rage and homesickness in order to complete the task at hand. Homer, living in Greek society, understood that his people thought more about the problem before coming to a quick conclusion and then acting on it impulsively. So, although both stories repeat the concepts of self-restraint and discipline as character building qualities, they differ in the way that these attributes build or weaken a personality. The story of Gilgamesh begins in the ancient Middle East, a land that was mainly war-faring and used take by force tactics to gain leadership, power, and fame. Since this was the prevailing opinions, the authors, few may it be, tended to define their heroes as men of quick, vicious action. Those who hesitated were run over by those who didnt. Character was built based on ones ability to act quickly and without uncertainty. Gilgamesh was involved in several situations in which he could choose to wait and act later or push forward and complete the task at hand. Gilgameshs brother, Enkidu, also did not use restraint in several of his performances. The very first instance of Enkidu doing such is when he is tempted by the harlot. Enkidu is half man and half beast when this happens. There he is. Now, woman, make your breasts bare, have no shame, do not delay, but welcome his love She was not ashamed to take him, she made herself naked and welcomed his eagerness (Gilgamesh 20). Enkidu did not refrain in the least from leaving his animal ways to go to the tempting woman. When he tried to return to the beast after his six days of passion, they rejected him, for he was now fully human. Because of his lack of will-power, Enkidu lost his life in the wild, but he also gained his life in the manly world. His character as a human was reinforced and was now stronger and wiser than before. A second example of a lack of patience comes from Gilgamesh in his decision to travel into the Cedar Forest and fight the terrible Humbaba. One day, he decides to fulfill his destiny and make a name for himself, and the next day, he is on his way. Gilgamesh does not think of the recourses of his actions and does not plan his adventure carefully and wisely. Even the elders tell him, you are young, your courage carries you too far, you cannot know what this enterprise means which you plan (Gilgamesh 25). As they continued to warn him of Humbabas strength, Gilgamesh paid no attention. Gilgamesh continues on with his plans, and Enkidu and Gilgamesh slay Humbaba. They are welcomed home with great appreciation by the people of Uruk, and all know that there character cannot be topped. Homeless in America EssayAfter this scare, Odysseus would never use such reckless abandon again. His character had been developed after this situation, but not because he succeeded, but because he had escaped with his life. Several more instances occur threw his telling of his journey, where Odysseus shows great will-power in making decisions, but some of the most important character-building occurrences happen as he re-enters his home city of Ithaka. Disguised as a beggar, Odysseus must first take a verbal and physical assault from one of his own workers, Melanthios. He is cussed for being a dirty beggar and then kicked in the hip. It takes Odysseus all of his strength to hold back from killing Melanthios in one blow, but he does hold back, and he keeps the secret of his arrival safe. After he has arrived at his own palace, Odysseus has been informed by Athena that he must beg the suitors for bread. He uses his experiences with each suitor to determine their capability and if they will be a problem. Once again, Odysseus must beg from the men who are taking house and home from him, and he does this with great cunning and discipline. The most difficult occurrence of Odysseus holding back happens when Antinoos becomes enraged with a comment that Odysseus had made. Antinoos responded, You think youll shuffle off and get away after that impudence? Oh, no you dont! The stool he let fly hit the mans (Odysseus) right shoulder Odysseus only shook his head, containing thoughts of bloody work (The Odyssey 426). The man that Odysseus was about to kill had physically struck him, refused to give him food and told him to get his filthy rags out of the room. As the reader of The Odyssey view this happening, they can only gain great respect for Odysseus great determination to wait for the right time. Normal people could not stand what he was going through without lashing out, but Odysseus held strong, and his character is shown to be even stronger than before. Homer builds Odysseus character slowly through the story and allows Odysseus to learn from his mistakes. Homer allowed his characters to develop through experience, thought and rationale. The ancient epics of Gilgamesh and The Odyssey both use many instances of restraint and discipline to help further develop the character of Gilgamesh, Enkidu, and Odysseus. This similarity is only true in that the heroes were developed through these qualities, but the stories differ in how each hero uses self-restraint to their advantage. Gilgamesh shows little or no rational thought before he tackled a challenge. He moved forward regardless, and he succeeded. His lack of self-discipline did not hurt his character, for he won each battle, and his people viewed him as a hero. In contrast, Odysseus at times did not show restraint and was punished for his actions. He only succeeded when he was able to hold back his raging emotions and wait for the time to strike. For this, Odysseus was praised as a leader and hero. Homer and the author of Gilgamesh both tell wonderful stories of adventure and conquest, but their stories also reflect the societies in which each lived. Regardless of the fact that Gilgamesh and Odysseus gained character in opposite ways, both societies in which they lived recognized their accomplishments and how they were achieved. Both societies accepted Odysseus and Gilgamesh as great heroes, and Homer and the author of Gilgamesh were successful in creating such developed characters.

Nucleosynthesis Essays - Nuclear Physics, Nuclear Chemistry

Nucleosynthesis The big bang which created the universe, only created the elements Hydrogen (H) and Helium (He) and possibly a very small amount of Lithium (Li). However, a glance at the periodic table of the elements shows that today (some 15 billion years after the big bang) there are at least 108 known elements. Every atom of every element heavier than Li has been produced since the big bang! The factories which make these elements are stars. Nucleosynthesis or the synthesis of nuclei, is the process by which stars (which start out consisting mostly of H and He) produce all other elements. The key is nuclear fusion, in which small nuclei are joined together to form a larger nucleus. (This contrasts with nuclear fission, in which a large nucleus breaks apart to form two smaller nuclei). Fusion requires an extremely large amount of energy (see fig. 1), and can typically only take place in the centers of stars. FIGURE 1 a) Low energy proton is strongly repelled by the 7Be nucleus.b) High energy proton moves so fast that it can strike the 7Be nucleus. Once the proton touches the nucleus, it has a chance to stick. If the proton sticks, the 7Be becomes a 8B nucleus.c) 8B is radioactive and changes into 8Be plus a positron (b+) and a neutrino (n). 8Be is itself radioactive, and almost immediately breaks into two 4He nuclei. Protons repel each other. This repulsion becomes stronger as the protons get closer together (just like when you try to stick two magnets together north to north, or south to south. Try this! As you push the magnets closer together, it becomes harder to do). However, if the protons can actually touch each other, they have a chance to stick together! This is because of the strong nuclear force which attracts nucleons (protons or neutrons) together, and is much stronger (at close range) than the electromagnetic force repulsion that makes protons repel other protons. (Magnets do not do this: two like poles will never stick together). In order to get a proton to strike another proton (or a nucleus that contains several protons) they must be traveling at high relative speeds; if their closing velocity is not great enough, they will never get close enough to stick together, because they strongly repel each other. But, just as you can make two of the same magnetic poles touch each other by providing sufficient force, so too can protons touch when they have sufficient relative speed. This can take place in the center of the sun, where the temperature is extremely high. Temperature is related to atomic motion: the hotter something is, the faster its atoms are moving [] see demo food coloring in water[]. Table 1 shows the nuclear reactions that are taking place in our sun, as well as nuclear reactions that take place in stars that are either older than our sun, or hotter than our sun. The reactions in columns 2 and 3 occur after a star has entered the red giant phase. How fast a star evolves to this point depends on its mass: stars heavier than the sun can reach this phase in less than 5 billion years (the age of the sun) whereas stars with about our sun's mass take about 10 billion years to get there. The particles you may be unfamiliar with are: n the neutrino, g a gamma ray (high energy light wave), and b+ the positron (the antimatter version of the electron). TABLE 1. Ellectoral College essays

Ellectoral College essays The Electoral College has been used to elect the President since the beginnings of the United States. In the two hundred some odd years of history, there have been instances when the college did not work. There have been many ideas that have floated around about fixing the problem with the electorate. Then again, there are many plusses to using the Electoral College system. In an election, the President is elected not by the popular vote, but by the votes of the electorates. The electorates are representative of each state. There are a number of electorates per state equal to the amount of persons in both the House of Representatives, and the Senate. The District of Columbia also has three votes to cast. One of the major drawbacks to the Electoral College is the fact that it can at times be very undemocratic. If a candidate wins the votes in certain states, and gets all their electoral votes, it is possible to win the Presidency, without getting the most popular vote. In the 1800s, there were three instances where the Electoral College disagreed with the popular vote. On the same note, in 1968, the race would have ended up in congress shy of a few votes for George Wallace. Again in 1976, the electoral vote gave Gerald Ford the victory even though Jimmy Carter one the most popular support. How would you fix this problem, there is no easy answer to this question. One way to solve this is send percentages of electoral votes, or ignore the winner-take all system. For instance, say that in Florida, who has 25 votes, 80 percent of the popular vote supports the democratic nomination, whereas the other 20 percent went for the republican nomination. Then 20 electoral votes would go to the democrat, and 5 would go to the republican. Another way to solve this problem would be to base electoral votes solely on the population, separate the nation into regions with approximately the same population, and give them each votes...

Consequently, the 100 percent CEI requirement is a good initiative of checking workplace discrimination on LGBT community in a work environment crippled by dearth of LGBT workplace protection law. Human rights must be protected from all dimensions. Every member of the society deserves to enjoy protection against discrimination of whatever kind. Consequently, it is difficult to object the demand by Diversity Inc’s requirement of 100 percent CEI for companies listed in their website, which is a public exhibition of companies that are socially responsible and zero tolerant to workplace

The Impact of the Increase of Cigarette Taxes Term Paper

The Impact of the Increase of Cigarette Taxes - Term Paper Example This term paper focuses mostly on the implication of the increased cigarette tax to smokers, to the target beneficiary of the law and to the government. The researcher also gives light on how the cigarette tax is implemented. Studies and articles reviewed in the paper show strong indication of positive and negative effects of additional cigarette taxes. It has pointed out that the low-income earners and the youth are the categories of smokers who are most likely to quit due to the economic reason of price. The real loser in any price increase is the smoking public who shoulders the cost passed on to them by manufacturers, distributors, and retailers through the tiers of taxes imposed by the government. The positive growth of government revenue is shown as tax increases government income. As a source of revenue, tax collections increase as higher taxes are imposed thereby providing a source of revenue for project allotments. In this term paper, the tax hike in 2009 is intended to bene fit the expansion of the State Children Insurance Program. But this is contradicted that the amount of collection will not be sufficient to support this program. The researcher then concludes that cigarette tax is a conflicting policy that has to be weighed in terms of revenue generation, health promotion, and social considerations. However, it is an economic tool that balances economic and social policy. In Asian experience, their policy favored the tax increase, in the same way, that this year, US has implemented cigar tax hike.

The Cost of Conflict Essay Example | Topics and Well Written Essays - 500 words

The Cost of Conflict - Essay Example There was a recent business article which featured two former Boeing employees. During the time, Michael Sears was the CFO and Darleen Druyun was the corporate vice president. Darleen decided to retire earlier from the Air force as a Number 2 acquisition executive. The beginning of the events that transpired was sparked by Darleen requesting Sears for jobs for two of family members. Darleen allocated a contract to Boeing out of the appreciation for the company for offering her and her two family members. This was seen as not only unprofessional and breach of codes of conduct but also a violation of established legislation. From the viewpoints of the participants the cost of this conflict could be seen both in terms of economy and development of the organization. It should be noted that the contracts were awarded not on the basis of merit but as a result of paying back for a favor done. This could have detrimental economic impacts to the company. This conflict had the potential of bringing down the company since the employees were not picked on the basis of their qualifications for the jobs they were expected to perform. The implication of this is that the employees could not be trusted to discharge their duties with the professionalism and dedication deserved. This conflict was resolved in court. Since it was a matter of breach not only to the professional codes of conduct but a matter of contravention to the contract law, the matter was brought before the court. Since both the participants were guilty, Darleen was sentenced to nine month’s imprisonment because of awarding the contract not out of qualification but gratitude because she and her two family members were given jobs by the company. Similarly, Sears was sentenced to four months in prison the reason being that he handled the employment in an improper way. He improperly and unprofessionally

Types Of Pollution And Their Effects Environmental Sciences Essay

Types Of Pollution And Their Effects Environmental Sciences Essay The introduction of harmful waste materials, other forms of contamination which are a hazard to the life sustaining atmosphere of the planet earth is commonly known as pollution. Pollution affects the ecosystem of the planet causes discomfort to almost every living organism on the face of the planet. It is the result of ever-increasing pollution into the environment that the ozone layer over the earth that defends us from the damaging ultraviolet rays of the sun is being depleted. Recent rise in the temperature of many countries across the world is also the result of the same. (Pollution) Types of Pollution Typically, there are main types of pollution, which are: Air Pollution Water Pollution Noise Pollution Land Pollution Air Pollution Air Pollution is the contamination of air in the atmosphere that is important for every living being on the planet to sustain life. The common air pollutants (the substances which cause pollution) include smoke and harmful gases from industries, CFCs and oxides produced by the automobiles, the burning of solid wastes, i.e. sulphur oxides, CO, CO2, particulate matter, NH3, smoke produced by explosives and other radioactive particles (e.g. Radon gas is released into the atmosphere because of radioactive decay within the Earths crust) being released into the atmosphere. Air Pollution can also be a consequence of the natural disasters such as a volcanic eruption. Ill-effects of Air Pollution Air pollution causes depletion of the protective ozone layer. It also has dire health effects on the individuals living on earth; it may cause respiratory problems, asthma, lungs and heart diseases, etc. Air pollution also affects the cardiovascular system, but the effects depend on the individuals exposure to the pollutants. How to prevent Air Pollution Since some of the reasons of air pollution are natural, there is hardly any sort of possible human control. But, for the human caused pollution, one of the finest ways to stop air pollution is to walk more or cycle more, rather than driving cars and other motor vehicles, because the emission from them is the most prominent form of air pollution in todays context. Regular and on-time maintenance of vehicles can also help reduce the pollution substantially. Usage of bio-fuels, like CNG, and bio-gas also aid prevention of pollution in the atmosphere. In order to make sure that these rules are being followed there could be some kind of legislation from the government in the respective countries to ensure that there is reduced pollution ever. (Pollution, Water Pollution, Air Pollution) Water Pollution Water is one of the most important natural resources on the planet which is one of the necessary elements to sustain life on earth. Addition of harmful products to water which make is unusable is commonly known as Water Pollution. These products could be chemical, biological or physical materials that deteriorate the quality of water and the lives associated with it. Some of the most common water pollutants include industrial wastes (which are directly dumped into the sea of lakes making the water unfit for fishes and other organisms living in the water), domestic and farm wastes, oil spills, pesticides, as well as mining and agricultural wastes. (Pollution, Water Pollution, Air Pollution) Ill-effects of Water Pollution About 40% of the deaths globally are accounted by water pollution. Polluted water affects the flora and fauna of the sea organisms and these organisms when consumed by humans, cause harmful diseases. Also, the contamination of drinking water, which is produced from natural water resources, causes diseases such as jaundice, cholera, or typhoid. How to prevent Water Pollution As such, there are no ways to ensure prevent water pollution. The most effective way to prevent water pollution is to generate consciousness among the masses about the ill-effects of the same and if possible, enforce laws to prevent disposal of harmful wastes into the water. Noise Pollution It is the excessive cacophony in the environment, primarily due to sounds created by machines. It is generally caused by loudspeakers, microphones, loud music, noise from industries, from construction and civil engineering works etc. Ill-effects of Noise Pollution The main problem that noise pollution, (also known as sound pollution), causes is that it affects the physiological and psychological health of an individual who is exposed to the excessive sound. Sometimes, it can even cause deafness and impaired hearing. It also causes annoyance which might result on blood pressure variations, ultimately leading to coronary diseases. How to prevent Noise Pollution Again, legislation can be one of the most effective ways to reduce noise pollution. Also creation of airports, bus stands etc away from residential areas can be an effective way. (Noise Pollution and its control) Land Pollution Degrading the earths surface by improper commercial, industrial, agricultural and domestic activities is known as land pollution. Dumping of e-wastes and other industrial wastes into the land causes land pollution. Insecticides, pesticides etc also harm the agricultural land and the soil. Mining, deforestation, oil refineries construction debris, etc are the most common land pollutants. Ill-effects of Land Pollution The agricultural capability of soil gets affected as a result of the land pollution, making it infertile and unusable for farming purposes. Also, it might result in the lowering of water table inside the ground. How to prevent Land Pollution In order to prevent land pollution, individual should be more focused on buying bio-degradable products and the products can also be recycled, i.e. recycling the inorganic materials should be an important focus. As far as organic compounds are considered, they can be dumped in places which are far away from residential places or agricultural lands. Reducing the use of pesticides and insecticides can also aid land pollution prevention. Oil spilling has to be taken care of. Anti-littering campaigns can be initiated to create awareness about ill-effects of littering. Conclusion In conclusion, it would be safe to say that pollution is very important to be controlled if life is intended to be sustained on the planet. It may be in different forms but if the masses can be properly informed and educated along with strict legislations, pollution can be controlled.

Operator In A Call Centre In India

Suppose you are working as an operator in a call centre in India and receiving calls from Americans and Londoners. How would you handle such calls? Ans: As an operator first thing which I would try and ask politely would be that what is the route cause of the problem of the customer and would try and give time for explaining or removing out the frustration after which the customer would then have patience in listening to what we would try and explain. As an operator I would rectify the problem by all the better means and try to explain the customer in a better way that he would get convinced completely with the solution which could rectify the same. I would also make sure that the customer has any doubts or clarifications regarding the same and reconfirm the same from the customer about the solution explained to him was clear. As an operator I would co-operate with the customer to completely resolve the problem which ultimately satisfy the customer.I would also thank the customer for having the patience and giving us an opportunity to troubleshooting the issue and getting it rectified. I don?t want to speak to you. Connect me to your boss in the US,† hissed the American on the phone. The young girl at a Bangalore call centre tried to be as polite as she could. UP DATED BENEDICT ARNOLD essays

UP DATED BENEDICT ARNOLD essays Benedict Arnold was born in Norwich, Connecticut. Arnold received his schooling at Canterbury. While away at school, a few of Arnolds siblings passed away from Yellow Fever. Arnold was a troublesome kid that would try just about anything. As a 14-year-old boy, he ran away from home to fight in the French and Indian War. Later, Benedict Arnold left and returned home through the wilderness alone to work with his cousins. The army had excused him without penalty because of his young age. In 1762, when Benedict was just twenty-one years old, he went to New Haven, Connecticut where he managed a book and drug store and carried on trade with the West Indies. (B Arnold) In 1767, he married Margaret Mansfield, a daughter of a sheriff of New Haven County. They had three sons together. When the Revolutionary War was just beginning to break out, Benedict Arnold became a prosperous ship owner, merchant, and trader. Within days, Arnold became very interested in the war once again and joined the American Army. All of the battles Arnold commanded over showed immense courage and bravery, but he was soon known as Americas greatest traitor due to his betrayal of the Americans. As the Revolutionary War broke out, Benedict Arnold decided to volunteer to head over 1,000 men up to Maine. He asked for additional men from his companies to join the army. Arnold then became a captain in the Connecticut Militia. General George Washington had his favorites, which Arnold was among the very few. So, Benedict Arnold was sent on an infernal 500 mile march to Maine by Washington, also known as The Rock. (Macks 72) Benedict Arnold and only about fifty percent of his original soldiers made it to the St. Lawrence River where they met up with General Montgomery. Their plan was to attack th e British Army by surprise in Quebec City, Canada. Both Montgomery and Arnold arranged to start on the lofty mountainsides of Quebec. Arnold and his so...

Atomic Mass and Mass Number Chemistry Review

Atomic Mass and Mass Number Chemistry Review Atomic mass and atomic mass number are two important concepts in chemistry. Heres a quick review of what is meant by atomic mass and atomic mass number, as well as how actual particle mass relates to atomic number. Atomic Definitions Z is used to signify the atomic number or proton number of an atomZ # of protons of an atomA is used to signify the atomic mass number (also known as atomic mass or atomic weight) of an atomA # protons # neutronsA and Z are integer valuesWhen the actual mass of an atom is expressed in amu (atomic mass units) or g/mol then the value is close to A Are Atomic Mass and Atomic Mass Number the Same? Yes and no. If you are talking about a sample of a single isotope of an element, the atomic mass number and the atomic mass are either very close or else the same. In introductory chemistry, its probably fine to consider them to mean the same thing. However, there are two cases in which the sum of the protons and neutrons (atomic mass number) is not quite the same as the atomic mass! In the periodic table, the atomic mass listed for an element reflects the natural abundance of the element. The atomic mass number of the isotope of hydrogen called protium is 1, while the atomic mass number of the isotope called deuterium is 2, yet the atomic mass is listed as 1.008. This is because natural elements are a mixture of isotopes. The other difference between the sum of protons and neutrons and the atomic mass is due to mass defect. In a mass defect, some of the mass of the protons and neutrons is lost when they bind together to form an atomic nucleus. In a mass defect, the atomic mass is lower than the atomic mass number. A Runaway Slave on the Underground Railroad Essay Example for Free

A Runaway Slave on the Underground Railroad Essay The heat here is terrible. Sticky, thick heat that sticks to your skin and clothes and makes it hard to breathe. The mosquitoes only make it worse. They don’t even wait for nightfall to come out anymore, but buzz around all day and torment us out in the cotton fields. I’ve got welts from their bites all up and down my arms and legs, and I’m afraid it won’t be long before there’s a yellow fever epidemic. As you know, it’ll be the babies that go first if that happens, poor little things. Clara just had her fourth last month, and Ether had her third just this week. There’s no rest for them, though. No, they had to be up and in those fields again the very next day after giving birth, carrying their little babies with them. You know we have to work from dawn to dusk, with only a short break to eat in the middle of the day. The overseers are always watching us, always so quick to strike out at us with the whip if they think we’re slacking off or not working hard enough or fast enough. We get so hot and tired and thirsty in those cotton fields, but there’s little in the way of relief except for a barrel of water with a ladle we all get to share from. I wish I was one of the house slaves, then I could be out of this heat and sun beating down on my back. The house slaves are treated a lot better than we are. They get to raise the white children and cook the meals and do the laundry, and become almost a part of the family. Oh, those white children love their black nannies! But I guess I’m not smart enough or pretty enough to be kept in the house. I’ve got another baby on the way, my second. I hope this one lives. I’ve determined to get out of here. I can’t go on like this. I hear there are people who will help. You’re lucky, Aunt, that you had a kind master who gave you your freedom, and that you found a good man to marry and take you up North where you can be free. If I find a way out of here, can I stay with you until I find work and a place to live? I’ve got to go now and take this letter to the house slave from the farm next door who will mail this for me. I can’t let anyone see me go, and I can’t let anyone know I can read and write a letter. That’s illegal here, did you know. Slaves aren’t supposed to be educated. So, I’ve got to sneak over there in cover of darkness. I hope to write to you again soon. Your loving niece, Libby July 17, 1853 Charleston, South Carolina Dear Aunt Betsey, The house slave from next door I told you about, remember him? His name is Milton. He’s the father of my baby, but as you know, slaves aren’t allowed to marry here. Anyway, he tells me he knows some people who will help me escape. They’re good people, he says, white people who hate slavery. They will get me off the plantation and to a safe house somewhere. Then the people at that house will get me to another house, and so on, all the way up to the North. I’m going to tell them that I want to go to my aunt Betsey Martin’s house in New Bedford, Massachusetts. I hope that’s all right. I hear New Bedford has a large population of us colored folks, and that we live right along with the white people there, side by side (McKivigan, 1999). I also hear there are good job opportunities, and that my baby can go to school with the white children. I don’t know when all of this is going to take place, so I can’t give you a time yet that I might be there, if this all works out and I don’t get shot trying to escape, or dragged back here to be whipped nearly to death, or worse. I admit, I’m scared of what might happen, but I have to try, for me and for my baby. Milton says he will follow me, as soon as he can. Your loving niece, Libby September 23, 1853 Ashville, North Carolina Dear Aunt Betsey, Well, I did it! I escaped the plantation. Three nights ago, I snuck over to Milton’s farm like I always do. I had packed a little bundle of most of my belongings that I slung over my shoulder. It wasn’t much. Just one other dress (my good one), some handkerchiefs, a hair brush, and some hard tack to eat, that was all. I knew if all went well, I wouldn’t be coming back. I won’t miss that plantation at all. I have no ties there, as you know. No family, since I was sold from the plantation where my mama and papa and brothers and sisters were 5 years ago. They sold my brothers and sisters at the same time as me, and I have no idea where they went. I guess I should count us lucky we got to stay together until I was 13. Not many slaves are that lucky. I’ve just been living in a cramped cabin with 5 other slave women with no family on the plantation, and they don’t care much what I do. They know I have a beau next door, and they keep quiet about my comings and goings, as most of them have beaus of their own they have to sneak out to see. At Milton’s farm, there were two white men and a white woman waiting inside Milton’s cabin. Milton lives on the edge of the property, near the fence, so no one from the house was likely to see the horses standing outside the cabin, and all the lanterns were blown out to make it extra dark besides. These white people were there to take me to a safe house in North Carolina. They had a horse for me, and some food in a little basket. I said my good-byes to Milton as quickly as I could, and he promised to come to me as soon as I was settled. Then, I got on my horse (I was scared, as I’d never ridden a horse before) and followed the white people on their horses into the woods. In two days, we came to the home of a nice store keeper and his wife, and they hustled me inside, where I’ve been staying in a nice, clean, cool bedroom with a real quilt on the bed and a wash basin to wash my face in the morning and water to drink whenever I want it. The woman of the house even gave me a new dress to wear. I’ve never felt so good, so clean. I’m to stay here until a new group of people comes to take me to the next stop. The woman of the house here said I’m now on the Underground Railroad. That’s what they call these safe houses along the way to the North (â€Å"What Was the Underground Railroad? †, n. d. ). The Underground Railroad. I like the sound of that. It’s the Underground Railroad to freedom. Your loving niece, Libby October 6, 1853 Alexandria, Virginia Dear Aunt Betsey, I think I am getting closer to you. One of the children in my new safe house showed me a map of the United States and showed me where I am now and where you are. On a map, it does not look so far away, but I fear the journey is still many miles yet. There was such a commotion in North Carolina, you would not believe! About a week after I escaped the plantation, a group of armed men came riding through town, putting up signs with a drawing of me on them, announcing a runaway slave and a reward for my return. The woman of the safe house dressed me up as a man, and hid me in her attic until the men had ridden through town, just in case they should come inside looking for me. They did not come in, thanks be to the Lord, but they did ask a the door if anyone had seen me. I was so afraid I would be given up for the reward, but these were good people who were protecting me. I never went outside the house, even to go to the outhouse, so there was never any chance of being seen and recognized by one of the townsfolk (I had a chamber pot for my use, and it was the job of one of the children to empty all the chamber pots every morning). I don’t remember how many days I was in the North Carolina safe house. One night, though, two free black women came to get me, and we walked together into the woods. We walked and walked, sleeping during the day and walking at night when it was easier to be invisible. They told me I was lucky, that most slaves who escaped the plantations didn’t have anyone to help them until they got further north. They said the Underground Railroad didn’t have too many operations in the South, at least not yet, and that most slaves were on their own in getting to that first stop on the Railroad (Blackett, 2002). I was lucky to have Milton, who knew the right people. These free women lived in New York state, but they were former slaves themselves, and they made it their business to help other slaves to escape to freedom like they did. They said they made many runs along the railroad to collect people, like they were doing for me. We must have walked for a week, but I lost track of the exact amount of time. Fortunately, I’m not showing in my pregnancy yet, so I don’t have a huge belly to carry around with me, and I can still run pretty fast when I have to. We’ve been lucky in that we haven’t encountered those men who were looking for me, and the only thing we ever had to run from is the occasional skunk or wild boar. I think god is looking out for me on this journey. We got to the next safe house in Alexandria in the middle of the night, just like before. This time, it was a family of Quakers who took me in. Quakers are some of the most active Christian abolitionists involved in the Railroad (Wallis, 1983). I found that I was not the only slave waiting to be taken North. There were six others waiting, three men, a younger boy who was almost a man, and two women. We stayed all together in the barn, but it was a nice barn, clean and full of sweet-smelling straw for us to lay on, and we were fed three large meals a day. We didn’t have to do any work. The family wanted us to learn a different way of life, one where we didn’t have to do all the work all the time. They wanted us to experience getting waited on. I must admit, it was strange, but it felt strange in North Carolina, too. I liked it, but I think it’s going to take some getting used to before not doing everything myself begins to feel anything less than strange. Your loving niece, Libby

Graduation Speech: Celebrate Your Unique Qualities :: Graduation Speech, Commencement Address

Welcome to all of you who have come to share this special evening with us. My name is John and I am a member of the graduating class of 2012. Standing here tonight is a surprise to me and to many who knew me. At one point, after making some mistakes and losing my sense of self, I dropped out of school. With my parents’ urging me, I enrolled at Alternative High School. I came to this school with the hope that I’d graduate on time. I knew that I would have to change, so I set goals to achieve perfection and I achieved it. As many of you may know, I am now perfect in every way, shape, and form... Yeah, right. What is true is that I had dropped out of school, was way behind my peers and enrolled at Alternative. I also worked to change my behavior. I’m still working at it. During the time that I have been at this school, I have had the pleasure of meeting many seniors, as well as other students, that were talented and often possessed wisdom beyond their years. Many have survived hardships in their lives that have developed their individuality and inner strength. Some are teen parents. Some have lost parents. Some live with lifelong illnesses. Some had families that moved constantly. Some felt different from their peers. They were artists, rebels and truth-seekers. All of them were ones who chose to walk to the beat of a different drum and found a way to follow their dreams at Bunny Alternatives. Alternative High School is a school that lifts us up and celebrates our unique qualities. We have had a channel for our voices — voices that may have been drowned out in the other crowded schools from which we came. For helping us find our strengths and our voice, we have a great number of people to thank. First, we need to appreciate the value placed on public education by the people of our country and most especially by the people of this district. Second, we need to thank the entire staff of Bunny Alternatives for encouraging us, standing by us and strengthening our skills to get us to this point in our lives. Above all, we, the Class of 2012, would like to thank our parents, mentors and friends for putting up with us during all the awkwardness of our growing up. Profit Leverage Effect of Logistics and Cost Saving Opportunities Essay

Logistics was initially a military term but since the 1960s it has grown and covers various numbers of functional areas such as managing raw materials and inventory, handling of work in progress, storing and delivering of finished goods. It also includes customer service, demand forecasting, plant/warehouse site selection, traffic and transportation. Since it has an effect on most of the activities held within an organization, it has a great influence on the profits made. A recent US study found that logistics accounts for 10% of the Gross Domestic Profit (GDP) and that approximately 56 cents out of every dollar of revenue is spent on managing the purchasing of goods and services.   The process is lengthy but once handled right can run very smoothly and can prove very beneficial to the organization. An organization cannot be competitive and strive in this fiercely competitive corporate world till it delivers end products or services of the desired quality to its customers at the right time, right place and at a price the customer feels is reasonable. The way to sustainable competitive edge lies in improving logistics. Therefore to maintain profit earnings, it is important for firms to manage logistics efficiently. If a chosen supplier fails to deliver the required raw material of an agreed-on quality level at the right time then the firm will incur additional expenses in the form of higher scrap rate, wastage and direct labor. Prompt delivery is required to avoid costly rescheduling of production otherwise efficiency will be decreased. In order to maintain profit levels it is important for firms not only to satisfy customers but to delight them. This again becomes a part of the organizations logistics. To achieve this not only fast and reliable delivery of high quality goods but also innovative design and distribution of ideas is essential. Firms stress on logistics to create differentiation by providing its customers with unique products that are difficult to be imitated by competitors. Logistics is considered as the last point of contact between the organization and its customer and so leveraging successful logistics leads to cost reduction, increased customer satisfaction and market share and so eventually higher profits. Low total product or service cost is significant in logistics so that the firm can have a competitive edge in the market. There are many opportunities to achieve dramatic cost savings but to achieve this, vision and hard work is required. Firms can do this by coordinating the different parts of the supply chain. Departments within firms such as procurement officer, manufacturing, legal and R&D managers need to work in a cross-functional manner and promote joint cost-saving projects. One of the biggest opportunities for cost saving is to reduce the amount of inventory which will automatically drive costs down. This can be done by Just-in-time inventory management that emphasizes on continuous improvement. For this, it is important for firms to develop strong relationship with few, reliable suppliers who deliver raw material in time.   Also Economic Order Quantity (EOQ) model, one of the common techniques is used to control inventory. Outsourcing is often used to transfer some of the internal activities of a firm to an outside vendor to achieve greater efficiency and specialization. It is also used as a technique to meet unexpected demands that firms cannot handle. Wastage can be eliminated through focus on what the customers want. This can be done by continuous improvement using Lean Production. It emphasizes on customer focus. Greater efficiencies can be accomplished through use of technology tools that can enable the purchase of low value, low risk goods and services. With the usage of database systems, unnecessary paper work can be eliminated, and real time data can be accessed. Use of E-Commerce to track inventory and coordinate pickup and delivery for end customers can be a great cost saving opportunity. This has been adopted by Cisco and FedEx. Different alternatives of distribution means such as trucking, airfreight, shipping, and railroads should be constantly evaluated. Use of Excel OM and Production and Operation Management (POM) for Windows’ enables firms to correctly plan for the forecasted demand. Further, software like Enterprise Resource Planning (ERP) including Supply Chain Management (SCM) and Customer Relationship Management (CRM) provide firms with great opportunity to save on costs. Gantt Charts are useful for loading and scheduling. It prevents firms from unnecessary delays in work. Quality is one aspect that firms emphasize on due to growing awareness for better quality goods amongst customers. This can be done by implementing Total Quality Management (TQM), meeting quality standards developed by International Standards Organization (ISO) and by adapting to Six Sigma and Plan-Do-Check-Act (PDCA) model. Mentioned above are some of the greatest costs saving opportunities in today’s world. References Lambert, D.M; Stock, J.R. and Ellram, L.M., (1998). Fundamentals of Logistics Management. Financial Implication of Decision

Evidencing the increased emphasis on exit strategy was research conducted during the mid-1960s through the mid-1970s that analyzed the exit process and created a framework that business decision makers could use to determine when and how to exit. For example, Conrad Berenson posited an exit model in 1963 that identified five categories of criteria used to evaluate a product abandonment decision: 1. Financial security, which entails determining if the minimum return on investment is being met for the firm; 2.Financial opportunity, or calculating the return on alternative uses of the firm's resources; 3. Marketing strategy, which determines the value of the product above pure financial profit, such as brand-name worth and the value of established distribution channels; 4. Social responsibility, or criteria that encompass the firm's responsibilities to customers, employees, suppliers, and so forth; and 5. Organized intervention, which takes into account actions by government, society, o r labor groups as a result of the decision to exit. And you need to anticipate the impact of key business decisions on your accounting and financial reporting. * Is your organization raising debt or equity? Acquiring a business? Carving-out a non-core operation? Complex accounting and financial reporting issues can arise as a result of changes dictated by your entity’s capital agenda. * Are you undertaking a significant business transformation? Assessing how a shared services center can improve efficiencies in your reporting process?Streamlining your accounting policies can help you reduce risk and manage cost. * Does the business operate in multiple jurisdictions? An assessment of your statutory reporting processes can allow you to manage risk, increase consistency in financial reporting, and realize efficiencies. * Are you planning to upgrade or replace your existing ERP system? Early assessment of changing accounting requirements should be incorporated into planned migratio ns to avoid expensive rework later.

Free Essays on The Mafia

The Mafia, also known as organized crime or the mob, began as early as the 9th century. By the early 1900’s every large state in the United States had its own Mafia sanction. They concentrated on protection rackets. Soon they expanded by racketeering in other areas such as gambling, prostitution, and bootlegging. But it wasn’t until Prohibition in the 1920’s that organized crime gained almost complete control of illegal bootlegging, narcotic trafficking, gambling, and many other illegal activities. â€Å"A clear line divided the underworld from the upperworld. Members of the Mafia spent most of their times in occasional spates of killing and stealing, as well as in all the mundane activities of any conventional life† (Fox 11). Somewhere between the killing, stealing, and conventional life, the gangsters made their own world. â€Å" It was a middle-earth of smoky nightclubs, the flash of chorus girls in a spotlight, a sprinkling of trumpet and saxophone, and time seemed to stop in a boozy moment of romance and glamour† (Fox 77). In the milieus the men of the underworld met to loaf and plot. Here too the people of the upperworld came to stand and gawk, to partake briefly of what they wanted only in small safe doses. â€Å"Because nightclubs, boxing matches, and racetracks had all been illegal or at least Curran 2 improper, they offered a natural habitat for these notorious gangsters. â€Å"The gangster’s presence made them all the more enticing to the upperworld, with a glistening edge of mystery and danger† (Fox 77). The Mafia participated in many illegal activities, but drug trafficking was one they seemed to flourish in. Their drug related activities posed a threat not only to the adult population who used drugs but also to the children involved as their agents. The trafficking of narcotics often led to many murders, which the Mafia never hesitated to partake in. Many gang wars took place throughout this period.... Albert Einstein3 essays

Albert Einstein3 essays When many people hear the name Albert Einstein, they say, Ooh what did he do, write a bunch of stuff on a chalkboard, prove to some scientists that he was right, and then star in a Pepsi commercial? Well, Im here to tell you that he did much more than that, (even though I really like that Pepsi commercial.) Albert Einstein was born March 14, 1879 in Ulm, Wrttemberg, Germany. Albert began his extensive studies at a school in Munich. At Munich he pursued a career in Electrical Engineering, but failed an exam and was rejected from Eidgenssische Technische Hochschule in Zurich. After failing at his original choice of schools, he went on to a secondary school in Aarau to train himself enough to be admitted into ETH (his original choice). While at Aarau he planned on becoming a teacher in mathematics and physics. As expected he did graduate from ETH in the year 1900 with a degree in teaching for the subjects of Math and Physics. He didnt however get a job right away, he, in fact, went around writing to different universities applying for one. After searching for about a year, he finally landed a job at a high school teaching mathematics. While at this school he wrote in one of his journals, I have given up the ambition to get to a University... After he went through this job, and indeed a couple more, his friend from school, Marcel Grossmann sought him out so his father could help him get a job. After a recommendation to the director of patents, Einstein held a temporary patent post, holding the title, Technical Expert Third Class. He was promoted several times over a span of about 5 years. While working at the patent office, he finished a boatload of theoretical physics publications. He even earned a doctorate on one from the University of Zurich. This paper was entitled, On a new determination of molecular dimensions. After publishing a few more papers, he began to be re...

Examples of Legends in Literary Texts

Examples of Legends in Literary Texts A  legend is  a  narrative - often handed down from the past - that is used to explain an event, transmit a lesson, or simply entertain an audience. Though customarily told as true stories, legends often contain supernatural, bizarre, or highly improbable elements. Types of legends include folk legends and urban legends. Some of the worlds most famous legends survive as literary texts, such as Homers Odyssey and  Chrà ©tien de Troyes tales of King Arthur. Folktales and Legends Although folktales and legends are both important genres of orally told narrative, in many ways they are decidedly different. As folklorists use the term, folktales are fictional stories; that is, they are regarded as fictions by those who tell and listen to them...Legends, on the other hand, are true narratives;  that is, they are regarded by their tellers and listeners as recounting events that actually took place, although to say so is an oversimplification....Legends are historical accounts  (such as the account of Daniel Boones encounters with Indians); or they are sorts of news accounts (as with contemporary or urban legends in which, for example, it is asserted that a madman with a hook arm recently attacked parked teenagers somewhere nearby); or they are attempts to discuss human interactions with other worlds, whether in the present day or in the past...However, in the social contexts in which legends  are told, attitudes toward the veracity of any given narrative may differ; some people may accept its truth, others may deny it, still others may keep an open mind but not commit themselves. (Frank de Caro, Introduction to  An Anthology of American Folktales and Legends.  Routledge, 2015) How Have Legends Appeared in Literary Texts? One of the worlds most famous legends is the story of Icarus, the son of a craftsman in ancient Greece. Icarus and his father attempted to escape from an island by making wings out of feathers and wax. Against his fathers warning, Icarus flew too close to the sun. His wings melted, and he plunged into the sea. This story was immortalized in Breughels painting Landscape With the Fall of Icarus, which W. H. Auden wrote about in his poem Musee des Beaux Arts. In Breughels Icarus, for instance: how everything turns awayQuite leisurely from the disaster; the ploughman mayHave heard the splash, the forsaken cry,But for him it was not an important failure; the sun shoneAs it had to on the white legs disappearing into the greenWater, and the expensive delicate ship that must have seenSomething amazing, a boy falling out of the sky,Had somewhere to get to and sailed calmly on.(From Musee des Beaux Arts by W. H. Auden, 1938) As stories handed down from the past, legends are often revised by each subsequent generation. The first stories of King Arthur, for example, were recorded in Geoffrey of Monmouths Historia Regum Britanniae  (History of the Kings of Britain), which was written in the 12th century. More elaborate versions of these stories later appeared in the long poems of  Chrà ©tien de Troyes. By several hundred years later, the legend was so popular that it became the subject of parody in Mark Twains humorous 1889 novel  A Connecticut Yankee in King Arthurs Court.

The Effects of Long-Term Care on the Quality of Life of the Elderly Essay

The Effects of Long-Term Care on the Quality of Life of the Elderly - Essay Example 1. Long term financial plans to underwrite the costs of LTC in a bid to resolve the problem of poor service delivery due to underfunding. Currently the funding of this sector is very low and with more people requiring such services soon, the system will be overburdened with financial needs. Nearly 70 % of those turning 65 in the year 2006 will need long-term care (LTC) in their lifetimes; 20 percent will need it for five years or longer. (Marcia, Clemmitt, 2006) 2. The staffing needs of the industry will be addressed by this study and thus help to plan staffing and labor related issues. The staffs available to deal with the huge numbers of elderly people are simply not available. An urgent recruitment and retraining of existing staff is necessary to cope with the challenges of new procedures and delivery systems. This issue is all the more acute taking into consideration that the need for caregivers will rise by 39%between 2000 and 2010, yet the population of those that make up the bulk of this workforce(18 – 55 tear old women) will increase by only 1.25%.(Marcia Clemmitt, 2006) 3. The appropriate service delivery systems necessary for the improvement of LTC and the future trends in relation to home and community based care of the elderly. Changing technology and newer treatments make it imperative that the delivery systems be continually updated to keep pace with the new developments. (Robyn I. Stone. 2000) The study will focus on how long term care (LTC) programs can be financed by the state and federal governments. It will identify the sources of income and possibly see how the general public benefitting from home based treatment and institutionalized care may contribute to this effort. The financial plan of this program must be long term in nature to take into consideration the increasing number elderly people that will need such care soon. Public insurance schemes like Medicare have been poorly managed. This study will examine how

Organizational Issues and Recommendations Essay

Organizational Issues and Recommendations - Essay Example Organizational Issues and Recommendations The Taylorist production approach was established by F.W.Taylor, who gave birth to Scientific Management. His school of thoughts is termed as Taylorism. Taylorism believed that any job can be learnt and taught. This theory treats the humans like machines and proposed that for the achieving higher production the management must eliminate inefficiency from its functioning. However, this theory completely neglects the usual complications that happen within a normal human being (Boyd, n.d). Taylorist production style supports the assembly line system where each worker performs the same task repetitively. Here the concept of division of labor was given significance and people started getting specialized in a certain domain while the rest of the production system remained unknown to them. A strict supervision policy was maintained within the organization which created distance between the management and the employees. The repetition of same task created frustration among the workers. The q uality of work started to decline which affected the management adversely. In turn the employees were threatened and scolded which ultimately resulted in more and more employee turnover. The management thought of forming groups for reducing the work pressure on individual employee and delegating each group with a particular task, like a group was responsible for making the engine and other relevant parts while another group worked on the creation of seat and the third group focused on the making the wheels of the car. The fourth group would work towards assembling the parts of the car and presenting the final product. The Issues faced by the firm The manufacturing unit realized that even after implementing the form of group work in their day to day operations, the problems like employee turnover and poor performance didn’t reduce. As they hired me as an HR consultant, I studied the various facets of the organization and reached the conclusion that the groups are suffering fro m several issues like role conflicts within groups, communication problems among group members, lack of cohesiveness in groups with diverse members and excessive intergroup conflict. Thus before proceeding with the recommendations towards solving these issues, it’s necessary to study the impact of each of this issue on the organization and the group in specific. The issues are discussed as follows- Role conflicts within groups This kind of conflict occurs between groups when the members feel uncertain about the role to be played by them. The group members might get a feeling that they are in charge of more than one responsibility within the setting of the organization and that the roles might prove to be contrasting each other. If the probability of two or more roles is irreconcilable, role conflict becomes prominent (Losh, 2011). For instance, a superior at a manufacturing plant might feel tensed due to the role played by him or her as the person poses to his juniors both as a friend and as a mentor at a time. Role conflict can occur due to non-availability of proper socialization facilities inside the organization. Group conflicts might take place due to several reasons which are- Misinformation and miscommunication Perceived or real disparity in the priorities and needs of the groups Perceived or real disparity in perceptions, values, culture, attitudes and beliefs Different structures
